The College Language Association is committed to protecting your privacy. This Privacy Policy describes how CLA collects, uses, and shares your information when you use and interact with our website and applies to all persons who log-in to our Membership Portal (“Users”). Our Privacy Policy governs your access to and use of the CLA website http://www.clascholars.org (the “Website”).

1. Applicability

You may visit the website without submitting any personal information. This Privacy Policy applies only to CLA’s collection, use, disclosure, and protection of your data to provide particular online services (the “Services”). It does not apply to third party websites, applications, or services. Before accessing, using, or interacting with the Services you should carefully review the terms and conditions of this Privacy Policy.

Our website and services are not intended for use by children sixteen and under. By using our website and Services, you represent to us that you are at least sixteen years old. If we learn that we have inadvertently collected any personally identifiable information from a child under the age of sixteen, we will delete that information. 2. General Data Collection & Use

CLA collects data about you (“Personal Data”) and your use of the services through various means, including when you provide information to us such as when you make an account, sign up for a membership, add information to your Profile, post comments, submit forms and applications, such as those for awards and scholarships, make a purchase, donate, register for in-person or online events, and volunteer.

CLA processes personal data collected through the website and services on the legal basis of legitimate interests to our users. We carry out this lawful collection of data to provide the Services to you.

3. CLA Membership & Account Information

When you join CLA, register for CLA events, and/or publish in CLAJ, CLA collects certain personal data from you. Personal Data refers to your username, password, user photo, and information about you that may be used to identify you, such as your first name, last name, title, workplace, responsibilities, interests, demographics, email address, phone number, and mailing address. CLA uses this information to provide your membership, register you for events, provide information about memberships and events, publish your articles, book reviews, and other manuscripts, and administer your registrations with CLA. Your CLA personal data such as your username may be displayed publicly when you post or comment on the CLA website. You are not required to provide your personal data to use the CLA website; however, we may not be able to provide certain Services to you if certain Personal Data is withheld.

4. Payment Transaction Information

We accept information related to purchases and donations through our website. You may provide payment Information such as your credit or debit card number, card expiration date, CVV code, along with your name and billing, delivery and shipping address to our Service Provider in order to complete payments. Transactions through Payroc, the company CLA has contracted with to process the secure electronic transaction, are used to provide services. This information is not stored by the CLA.

Please note CLA works with service providers as listed below. You are subject to the Privacy Policies and Terms and Conditions of our Service Providers when purchasing a CLA membership, registering for CLA events, shopping for CLA products, or making donations, the terms of which may differ from those of CLA for Services provided by CLA. 5. Communication Preferences

We may keep your message, email address, and contact information to respond to your requests, provide the requested products or Services, provide notifications or other correspondences to you and to assist with support requests. Please do not submit any information to us, including confidential or sensitive information, that you do not wish for CLA or our service providers to have access to or use in the future.

Unless we receive from you an expressed written request to cease all communication, we may still contact you as needed for service-related communications such as account verification, changes or updates to features of the services, or technical and security notices. Current CLA Members will receive their summer and winter mailings, publication notifications, renewal notices, and all other Service-related communications.

6. Public Information

CLA may also collect information about you from publicly available sources. Information you make publicly available in any public or open forum, such as on a social network or an email discussion list, may be considered public information for the purposes of this Privacy Policy, and may be accessed and collected by CLA. Please be aware that any content or information you share with or provide to third parties using or related to your use of the Services is neither private, nor confidential. CLA is not responsible for any content or information you post or share with third parties. If you do not wish for certain information to be public, please do not share it.

7. CLA Executive Committee and Service Providers

CLA’s Executive Committee members and Service Providers such as website companies may have access to your information as needed to provide and operate the Services in the normal course of business. This includes information regarding your membership. If CLA becomes aware that a Service Provider is using or disclosing information improperly, we will inform you and take commercially reasonable steps to end or correct such improper use or disclosure.

CLA works with service providers including Payroc, JSTOR, Project Muse, and Google. The list of providers is considered part of this Privacy Policy. CLA shares your data, including personal data, with our website hosting service providers for the purposes of processing your data pursuant to your use of the Services.

8. Personal Data Rights and Choices

Personal data protection laws provide you certain rights regarding the protection of your data, including the right to:

  • Right to access or a copy of the personal data undergoing processing upon request.
  • Right to have incorrect data rectified and to have incomplete Personal Data updated.
  • Right to request erasure or removal of personal data.
  • Right to withdraw consent to process personal data.
  • Right to restrict the processing of personal data, but CLA may continue to store your personal data.
  • Right to object to processing personal data for the purposes of profiling and statistics.

CLA provides registered users with a profile which has settings within the services to help you access, correct, delete, or modify your personal information associated with the services. CLA welcomes you to contact us regarding the information we have collected about you, including regarding the nature and accuracy of the data that has been collected about you, to request an update, modification, or deletion of your information, to opt-out of certain Services, uses of your information, or to withdraw any consent you may have granted to CLA.

Please note that requests to delete or remove your information do not necessarily ensure complete or comprehensive removal of the content or information posted; removed information may persist in backup copies indefinitely. Note also that if you choose to delete your information or opt-out of the collection and use of your information, you understand that certain features, including but not limited to access to the services, may no longer be available to you.

We may store the information we collect about you indefinitely, but information generally will be retained only for as long as necessary to fulfill the purposes for which the information was collected, or as otherwise required by law. Following termination or deactivation of a CLA account, CLA may retain your information and content for a commercially reasonable time for backup, archival, and audit purposes.

CLA takes reasonable measures  to secure and protect the privacy, accuracy, and reliability of your information and to protect it from loss, misuse, unauthorized access, disclosure, alteration, and destruction. CLA implements security measures as we deem appropriate and consistent with industry standards. CLA cannot guarantee the security of our systems or databases, nor can we guarantee that personal information we collect about you will not be breached, intercepted, destroyed, accessed, or otherwise disclosed without authorization. Accordingly, any information you transfer to or from Services is provided at your own risk. We assume no liability for any of these actions or occurrences or their results.

Our website may contain links to other websites. CLA is not responsible for the privacy practices or content of other websites.

11. Transfer & Storage of Your Information

The information CLA collects about you may be transferred, processed and/or accessed by us in the United States, or in another country where we or our service providers operate. Please be aware that personal data may be transferred to, and maintained on, computers located outside of your state or country where privacy laws may differ from and may not be as protective as those where you live. If you are located outside the United States and choose to allow us to collect information about you, please be aware that CLA may transfer your personal data to the United States and process and store it there.

If you are located in the European Economic Area (“EEA”) or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information to a country or jurisdiction that does not have the same data protection laws as your jurisdiction, as disclosed in this Privacy Policy. It may also be processed by the CLA Executive Committee or staff operating outside the EEA who work for us or for one of service providers, also as disclosed.

12. Modifications to Our Privacy Policy

CLA reserves the right to modify this Privacy Policy. You may contact us to obtain prior versions. We will notify you of material changes to this policy by posting a notice in News and Announcements on our website or by emailing you at an Email address associated with your CLA account.
